Chapter 23: Vacated
Joan Bracken went home on Saturday, and on Monday she went to court.
She went in her wheelchair, in her good navy coat, with her hair set by a neighbor and a thermos of tea on her lap.
"I'm not missing it," she told the nurse who tried to stop her at the door. "I missed the first one."
Courtroom Four was full.
Reporters filled the back rows, the old boss sat in his Sunday jacket with the youngest mechanic beside him, and the green-dress reporter stood at the rail with her pen already moving.
Kira sat on Cal's left with her hand in his.
On his right, in the aisle, his mother's chair squeaked once and stopped.
The judge with the reading glasses came in and took her seat.
"Be seated," she said.
The room obeyed.
"We are here on the motion of the district attorney in the matter of the State against Calvin Bracken."
The district attorney was a tall man with a tired face, and he rose slowly.
"Your Honor, the state moves to vacate the conviction and to dismiss the charge with prejudice."
"On what grounds?"
"That the defendant did not commit the offense." He cleared his throat. "That a witness, a confession recording and the vehicle's repair records show the driver was Preston Ridgway. That the defendant's plea was procured by fraud, and the state's own file was shaped to hide it."
Cal felt his mother's hand find his sleeve.
"The state offers its apology," the district attorney said. "It will not be enough."
