Chapter 19: The Card in Open Court
The hearing was set for nine on Monday in a courtroom with oak benches and a seal on the wall.
By 8:40 every seat was taken.
The families from the Malibu meeting filled the left side of the gallery, in their good clothes, holding paper cups.
Behind them sat the reporters, and behind the reporters sat the woman in the navy coat and her thirteen-year-old daughter.
The girl lifted two fingers to me, and I nodded.
Hayes sat in the first row behind my table.
He wore a plain gray suit and no watch, and he had not spoken since the elevator.
Camille came in last, in white.
She walked the whole length of the aisle with Duchess in her arms, and the families watched her pass in silence.
The judge took the bench.
"This is a hearing on the plaintiff's motion," she said. "Mr. Dunning, you have been subpoenaed. Please come forward."
Fred stood up in the back row, in the dark suit he had worn to his daughter's wedding.
He walked to the witness box and put his hand on the book.
"State your name for the record."
"Frederick Dunning. Fifty-eight. Chief pilot of Grosvenor Aviation until Tuesday."
Camille's attorney stood and buttoned his jacket.
"Mr. Dunning, did you remove a recorder card from Guardian One without authorization?"
"I did."
"Two cards?"
"Two."
"That's theft of company property."
"It's a flight safety recording," Fred said. "After a fatal event the pilot's required to preserve it. Somebody had already deleted the ground tape from the ops desk, so I preserved the rest."
"Objection," the attorney said. "That's argument."
